Terms of Service

1. Introduction and Acceptance

Welcome to Sailtrax. These Terms of Service ("Terms") govern your use of the Sailtrax mobile application and related services (collectively, the "Service") operated by Nikolas Molinari ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Sailtrax is a sailing companion application that provides:

You must be at least 16 years of age to use the Service. By using Sailtrax, you represent and warrant that you meet this age requirement.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To access certain features, you must create an account using Google Sign-In, Sign in with Apple, or another authentication method we provide. You agree to:

5.3 Data Storage Duration

When we refer to "permanent" or "forever" storage of voyage data, this means:

  1. Lifetime of the Service – We will retain your voyage data for as long as Sailtrax continues to operate. If we discontinue the Service, we will make reasonable efforts to notify you in advance and provide an opportunity to export your data.

  2. No Guarantee of Preservation – While we implement industry-standard backup practices, we do not guarantee that data will never be lost. Technical failures, unforeseen circumstances, or force majeure events may result in data loss.

  3. Best Efforts Basis – Data storage is provided on a "best efforts" basis. We are not liable for any loss of voyage history data, regardless of the cause.

We recommend that you maintain your own records of any voyage data that is important to you. Do not rely solely on our Service for long-term preservation of critical data.

6. Payments and Subscriptions

6.1 In-App Purchases

Premium features are purchased through the Apple App Store or Google Play Store. All payments are processed by the respective platform.

6.2 Pricing

Prices are displayed in the app at the time of purchase and may vary by region. All prices include applicable taxes unless otherwise stated.

Refund requests are handled by Apple or Google according to their respective refund policies:

7. Yacht Data and Intellectual Property

7.1 Yacht Telemetry Data

The sailing telemetry data (tracks, speed, wind, etc.) is collected from yacht onboard instruments and belongs to the yacht operator or charter company. Your purchase grants you a license to access and view this data, not ownership of it.

7.2 Your Content

If you upload any content to the Service (e.g., profile pictures), you retain ownership of that content but grant us a limited license to use it for providing the Service.

7.3 Our Intellectual Property

The Sailtrax name, logo, application design, and all associated intellectual property are owned by us. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

While we strive for accuracy, we do not guarantee that the sailing data displayed is accurate, complete, or current. Data depends on the yacht's onboard instruments and connectivity.

11. Limitation of Liability

To the maximum extent permitted by law:

  1. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

  2. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater.

  3. We are not liable for any loss of data, loss of profits, or business interruption.

These limitations apply regardless of the legal theory (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

You agree to indemnify and hold harmless Nikolas Molinari and any affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

14.1 Governing Law

These Terms are governed by the laws of Austria, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Vienna, Austria.

14.3 EU Consumer Rights

If you are a consumer in the European Union, you retain any mandatory consumer protection rights granted by the laws of your country of residence.

We may update these Terms from time to time. When we do:

  2. We will notify you of material changes via email or in-app notification
  3. Continued use of the Service after changes constitutes acceptance of the new Terms

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

You may not assign or transfer your rights under these Terms without our consent. We may assign our rights and obligations without restriction.
